Terms and Conditions

  1. OUTLINE

1.1 Her. Women’s Health agrees to provide physiotherapy services to you on the terms set out in these terms and conditions (the Agreement). The Agreement represents the entire understanding between the Parties. Except for those terms implied by law and which cannot be excluded and any other terms specifically incorporated by reference, no other terms shall apply.

  1. CONSENT

2.1 You signify your consent to this Agreement by purchasing any physiotherapy services from Her. Women’s Health. This Agreement may be altered from time to time. The version in force at the time of each engagement governs services provided in relation to that engagement.

  1. NATURE

3.1 You acknowledge that services provided by Her. Women’s Health are provided virtually or via telehealth and may not be an exact substitute for a physical consultation with a physiotherapist. Her Women’s Health will provide advice and recommend treatment on the basis of our expertise, but we cannot guarantee that treatment will lead to desired results.

  1. SUITABILITY

4.1 It may become obvious to us that our physiotherapy services are not suitable for you. In these circumstances, we will cease providing physiotherapy services to you and, at our sole discretion, provide a refund.

  1. PROVISION OF INFORMATION

5.1 You acknowledge that in delivering physiotherapy services, Her Women’s Health are reliant upon the information that you provide us. In this regard, you agree to provide us with accurate and complete information in intake surveys and any further questions we ask you. You will endeavour to provide us with all information relevant to your condition or treatment.

  1. USING OUR PHYSIOTHERAPY SERVICES

6.1 You must not implement our treatment program or act on any advice unless you fully understand it. If you do not understand, or have any questions, please let us know. If you experience any pain or discomfort, please alert us immediately and cease using the treatment program.

  1. LIABILITY

8.1 The laws in force in Queensland and Australia imply certain terms into contracts between consumers and businesses. Such terms form part of this Agreement. Otherwise, to the extent permitted by law, we exclude all liability to you in relation to our physiotherapy services, of whatever nature and however arising. Where liability cannot be excluded, we agree that liability incurred by Her Women’s Health in relation to our physiotherapy services is limited to $1,000, unless otherwise agreed.

  1. PRIVACY

9.1 We will treat your information in accordance with our Privacy Policy.

  1. GOVERNING LAW

10.1 This Agreement is governed by the laws in force in Queensland, and you submit to the jurisdiction of the courts in that State.

  1. DEFINITIONS

11.1 In this document, the following terms have the following meanings:

‘Agreement’ means the terms and conditions of purchasing our physiotherapy services as set out in this document;

‘Her. Women’s Health’ means Caitlin Pender, a sole trader operating through a registered business name, ABN 29412870121; and

‘Physiotherapy services’ means any physiotherapy or health-related services provided by us including any assessment, diagnosis, advice or treatment program.
